According to a comprehensive compilation report by the US "World Journal", the US Citizenship and Immigration Services (USCIS) canceled a Trump administration's policy that is not conducive to immigrants applying for visas and green cards.

 

In 2018, the former government’s immigration policy allowed USCIS adjudicators to reject applications with omissions or negligence in documents, and no amendments or supplements were allowed. Trump's immigration policy has a negative impact on immigrants who are applying and preparing to apply for visas. At that time, USCIS personnel had greater power to refuse to accept cases of negligence and omission, and did not give applicants the opportunity to amend and supplement.

 

Now, USCIS personnel will issue a request for supplement (RFE) or notice of intent to reject.

The Department of Homeland Security (DHS) stated in a policy reminder in early June that the policies of the previous government caused USCIS to reject many applicants for immigration benefits, and these people would be eligible if they had the opportunity to make replacements. This policy affects almost all immigration applications, including U.S. citizenship, permanent residence, green cards and visas.

 

According to the old rule, when the applicant’s documents are insufficient or there is unintentional negligence, the USCIS adjudicator will issue reminders, including a request for supplementary or a notice of intent to deny; these notices will give immigrants and their lawyers the opportunity to remedy the case before the final decision to avoid the application rejected.

 

For some people applying for visa renewal, the rejection of their application means that they must leave or be deported after their visa expires.

 

Now that USCIS has changed back to the ruling principle in the 2013 memorandum, the authorities need to issue a supplementary request or veto notice of intent to assist immigrants in obtaining immigration benefits. USCIS stated: "This updated policy ensures that applicants have the opportunity to correct inadvertent negligence and unintentional missing documents."

 

USCIS pointed out: “On the whole, USCIS staff believes that additional data and explanations may help the applicant to obtain immigration qualifications, they will issue a supplementary request or a notice of intent to deny.”

 

USCIS stated that the update of this policy aims to improve immigration services. The bureau also announced that some applicants can extend their one-year work visas to two years after their status has been adjusted.
