The Biden Government Has Expanded the Citizenship Rights of Overseas Births, and Such People Can Directly Obtain a Green Card!

The Biden Government announced on Thursday that it will change its interpretation of US immigration laws, allowing children born overseas to parents who use assisted reproductive technologies (such as surrogacy) to qualify for US citizenship or green cards.

According to the USCIS, infants born overseas by married couples including a U.S. citizen will no longer need to have biological contact with the father or mother of the U.S. citizen to qualify for U.S. citizenship, and family-based immigration benefits.


According to the latest immigration guidelines, as long as one of the parents is a U.S. citizen and has a genetic relationship with one of the parents, the baby can meet the eligibility criteria. The prerequisite is that the parents must be married and recognized as the legal guardian of the child in their place of residence.

 

Before the Biden Governmentannounced the policy change, U.S. law previously defined such ineligible children as "illegitimate", preventing them from obtaining U.S. citizenship and other benefits.

 

The Trump administration’s support for this legal interpretation has led to lawsuits by several pairs of same-sex couples who believe that their children have been unfairly deprived of their U.S. citizenship.
